Why is Benjamin Montgomery chilling with my player

this is what it is in game and at fist you would think hey this is great he is my meat shield but no.
When your trying to sneak past npcs this man will start shooting and making sneaking by enemy's impossible I don't think its my load order because this happens without mods but I will bit my load order maybe you can see things I cant.

I have only seen one other person complain about this but I cant think of what would cause it I'm running windows 10 but I don't think that's it any help would be appreciated.

Well i figured out what it was turned out it was the save i downloaded so i did not have to do the vault opening i downloading a clean save file and boom it worked
